Terms of Service

Welcome to Swole! These Terms of Service ("Terms") govern your use of the Swole mobile application (the "App") operated by Loot Finance ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Use of the App

1.1 Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

1.2 Account

You are responsible for maintaining the security of your device and Apple ID. You are responsible for all activities that occur under your account.

1.3 Permitted Use

You may use the App for personal, non-commercial fitness tracking purposes. You agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the App's functionality
  • Use automated systems to access the App

2. Subscriptions and Payments

2.1 Coach Pro Subscription

The Coach Pro feature requires a paid subscription. Subscriptions are billed through your Apple ID account.

2.2 Subscription Terms

  • Monthly Plan: Billed monthly at the current price
  • Annual Plan: Billed annually at the current price
  • Prices are displayed in the App and may vary by region

2.3 Auto-Renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

2.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings:

  • Open Settings on your device
  • Tap your name, then Subscriptions
  • Select Swole and tap Cancel Subscription

Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

2.5 Price Changes

We may change subscription prices at any time. Price changes take effect at the start of your next subscription period.

3. Fitness & Health Disclaimer

3.1 Not Medical Advice

The App, including all workout programs, exercise recommendations, rest timer suggestions, and AI Coach features, provides general fitness guidance only. Nothing in this App is intended to be, or should be construed as, medical advice, diagnosis, or treatment. The App is not a substitute for professional medical advice.

3.2 Consult a Professional

Before starting any exercise program, using the App, or making changes to your training:

  • Consult with a qualified healthcare provider
  • Consult with a certified personal trainer or strength coach
  • Consider your individual health conditions, injuries, and physical limitations
  • Obtain medical clearance if you have any pre-existing conditions

3.3 Assumption of Risk

You acknowledge and agree that:

  • Weightlifting and physical exercise carry inherent risks of injury, including but not limited to: muscle strains, ligament tears, joint injuries, spinal injuries, cardiovascular events, and in rare cases, death
  • You voluntarily assume all risks associated with using the App and performing any exercises or programs contained therein
  • You are solely responsible for determining whether any exercise, weight, or program is appropriate for your fitness level and physical condition
  • You must use proper form and technique, which the App cannot monitor or correct
  • You should stop exercising immediately if you experience pain, dizziness, or discomfort

3.4 Workout Program Disclaimer

The built-in workout programs (including Strong 5x5, Wendler 5/3/1, GZCLP, and any other programs) are:

  • General templates designed for educational purposes, not personalized training plans
  • Not tailored to your individual fitness level, experience, injuries, or limitations
  • Provided "as-is" without any guarantee of results or safety
  • Based on general fitness principles that may not be appropriate for all users

You are solely responsible for:

  • Assessing whether any program, exercise, or weight is appropriate for you
  • Modifying or skipping exercises as needed for your safety
  • Using appropriate weights that you can safely control
  • Ensuring you have proper equipment and a safe training environment

3.5 AI Coach Limitations

The AI Coach feature:

  • May provide inaccurate, incomplete, or inappropriate recommendations
  • Cannot see your form, technique, or physical condition
  • Does not have access to your medical history
  • Should not be relied upon for injury prevention, diagnosis, or rehabilitation
  • Is not a replacement for a certified personal trainer or coach

We are not liable for any injuries, damages, or losses resulting from following AI Coach recommendations or using any feature of the App.

4. Intellectual Property

4.1 Our Content

The App, including its design, features, code, and content, is owned by Loot Finance and protected by intellectual property laws.

4.2 Your Content

You retain ownership of any workout data you enter. By using the App, you grant us a license to use this data to provide and improve our services.

4.3 Feedback

If you provide feedback or suggestions, we may use them without obligation to compensate you.

5. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

6. Service Availability

6.1 Availability

We strive to keep the App available but do not guarantee uninterrupted access. The App may be unavailable due to:

  • Maintenance and updates
  • Technical issues
  • Factors beyond our control

6.2 Internet Required

Certain features (AI Coach) require an internet connection. These features will not function offline. CloudKit sync is coming soon and will require an internet connection when available.

6.3 Changes to the App

We may modify, suspend, or discontinue any part of the App at any time without notice.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF CONTENT

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOOT FINANCE SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS, DATA, OR GOODWILL
  • PERSONAL INJURY OR PROPERTY DAMAGE
  • ANY DAMAGES EXCEEDING THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS

9. Indemnification

You agree to indemnify and hold harmless Loot Finance and its officers, directors, and employees from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

10. Termination

10.1 By You

You may stop using the App at any time by uninstalling it from your device.

10.2 By Us

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users or us
  • Is fraudulent or illegal

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date

Continued use of the App after changes constitutes acceptance of the new Terms.

14. Apple's Terms

Your use of the App is also subject to Apple's Standard EULA.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Loot Finance regarding the App.
